Commercial ITAR refers to the export and re-export of commercial items and technology that are subject to the International Traffic in Arms Regulations (ITAR). The term “commercial” is used very broadly and includes all items, except those classified as EAR99, for which a license or other approval from the U.S. Department of State is required for export. The defense trade controls and regulations are designed to control the export of items that have potential military applications and prevent the proliferation of weapons of mass destruction.

If a product or technology meets all three of these criteria, then it is considered commercial and can be exported without a license from the Department of State. However, if the product or technology does not meet one or more of these criteria, then it is subject to the ITAR and a license may be required.
Related technical data and defense services may also be subject to the ITAR, even if the product itself is not. For example, technical data relating to the design of a commercial item may be subject to the ITAR if it is required for the development, production, or use of a defense article.
